The petitioner seeks regular bail in connection with Phulwarisharif P.S. Case No. 714 of 2019 for the offence registered under Sections 419, 420, 467, 468, 471, 472 and 120(B) of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act.

The allegation is regarding the Police having intercepted a Scorpio vehicle and upon checking, six people were arrested whereafter it transpired that the said persons were running a job racket and after receiving cash from the aspirant they used to indulge in impersonating actual candidate by a competent candidate, so as to procure government job for them.

Patna High Court CR. MISC. No.77286 of 2019(3) dt.17-12-2019 2/2 As far as the co-accused Dhiraj Kumar Singh is concerned, huge cash was recovered apart from recovery of A.T.M card, driving license, forged admit cards etc.

The learned counsel for the petitioner has submitted that the petitioner is driver of the car and has got no complicity in the matter as would also apparent from the case dairy and as far as the seizure list is concerned, only one mobile is stated to have been recovered from the possession of the petitioner. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 23.07.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Patna in connection with Phulwarisharif P.S. Case No.714 of 2019.
