The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341,323,504,354A, 363, 366A/34 of the Indian Penal Code. The statement of the victim girl recorded under Section 164 Cr.P.C. would reveal that the victim was aged about 17 years and she has stated that she had love affairs with the petitioner and she wanted to marry with the petitioner, which was not liked by the family members, hence she voluntarily placed her house and went along with the petitioner to Muzaffarpur and married thereat.
Considering the statement of the victim girl, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the
Patna High Court CR. MISC. No.76753 of 2019(2) dt.02-12-2019 2/2 date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Hussainganj P.S. Case No.223/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
