The learned counsel for the petitioner submits that Title Suit No. 49 of 2021 has been filed in the Court of SubJudge, Birpur and in these circumstances, he prays for withdrawing this application to prosecute the title suit. Any judgment in the Title Suit will decide the rights of the parties so far as the mutation of the land is concerned. It is well settled that mere mutation does not create any right title or interest in favour of anyone.
