2. The petitioner has prayed for bail in connection with Bihariganj P.S. Case No. 400 of 2025 registered for the offence punishable under Sections 316(2), 316(5), 318(3) of the B.N.S., 2023.
3. The allegation against the petitioner is that Chairman Shekhpura PACS, Bihariganj, has purchased a total of 4829.11 quintals of paddy, and only 2320 quintals of CMR were supplied to the Bihar State Food Corporation, and the rest, 994.70 quintals of rice, could not be supplied. As such, it has been stated that a total of Rs. 33,73,830.75/- was embezzled by

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the petitioner has annexed AnnexureP/2, which is a certificate of Bihar State Cooperative Bank to the effect that this is to certify that there is no outstanding against paddy procurement FY-2024-25 in cash credit Account No. 000915002000212 in the name of Shekhpura PACS, BlockBihariganj, Dist. Madhepura. It has also been submitted that the entire dues have been submitted. Moreover, the petitioner is having criminal antecedent of one case and is languishing in judicial custody since 19.09.2025.
5. Learned APP for the State has also conceded that Annexure-P/2 goes to show that the entire due has been deposited by the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief
