The petitioner apprehends his arrest in connection with Sarai P.S. Case No. 277 of 2019 for the offence punishable under Sections 363/366(A) and 34 of the Indian Penal Code. The allegation is regarding the petitioner having kidnapped the victim girl.

The learned counsel for the petitioner has referred to the statement made by the victim girl under Section 164 Cr. P.C. before the learned Magistrate, wherein she has disclosed that her age is 18 1⁄2 year and she has further stated that she had not been kidnapped and she had voluntarily gone with the petitioner and solemnized marriage with him as well as she is living peacefully

Patna High Court CR. MISC. No.79716 of 2019(3) dt.13-12-2019 2/2 with her husband i.e. the petitioner herein without any difficulty. The petitioner is stated to be having a clean antecedent. Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioner above named is directed to be released on anticipatory bail on furnishing bailbonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIII-cum- SubJudge XIV, Vaishali at Hajipur in connection with Sarai P.S. Case No. 277 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
