The petitioner apprehends his arrest in connection with Sultanganj P.S. Case No. 211 of 2019, G.R. No. 3743 of 2019 for the offence punishable under Sections 313 and 376 of the Indian Penal Code.

The allegation is regarding the petitioner having solicited sexual pleasure with the informant of the present case on the pretext of marrying her.

The learned counsel for the petitioner submits that on account of the fact that the petitioner, being the Ex. Principal of the school in question, had not regularized the services of the

Patna High Court CR. MISC. No.77283 of 2019(3) dt.16-12-2019 2/2 informant, who was privately employed by the petitioner as a cook, and had instead removed her from service, the petitioner has been falsely implicated subsequently by the informant with oblique motives. It is further submitted that the matter has been compromised and settled in between the parties. Lastly, it is submitted that the petitioner is having a clean antecedent and is a person of dignity and has deep roots in the society.

Having regard to the facts and circumstances of the case and considering the materials available in the case diary, I deem it fit and proper to direct that in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioner above named is directed to be released on anticipatory bail on furnishing bail- bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate 1st, Bhagalpur in connection with Sultanganj P.S. Case No. 211 of 2019, G.R. No.3743 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
