Petitioner seeks bail in a case registered for the offences punishable under Sections 302,201 and 120B of the Indian Penal Code.
Only suspicion is there against the petitioner to have committed murder of the brother of the informant. Petitioner is in custody since 17.06.2019. Investigation of the case is already complete. There is no material to substantiate that the petitioner is not going to cooperate with the trial or is to tamper with the evidence. Co-accused-Kundan Yadav has already been allowed bail by a Coordinate Bench of this Court in Cr.Misc. No.71062 of 2019.
Considering the aforesaid facts, let the petitioner,
Patna High Court CR. MISC. No.76903 of 2019(2) dt.13-01-2020 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Lodipur Police Station Case No.102 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
