The petitioners are apprehending their arrest in connection with Complaint Case No.524 of 2014 registered for offences punishable under Section 498A of the Indian Penal Code.

Petitioner no.1 happens to be husband of the complainant, petitioner no.2 is the mother-in-law and the petitioner no.3 is the wife. Case is under Section 498A of the IPC. Submission of the learned counsel for the petitioners is that the allegation is false and concocted and he is still ready to

Heard learned A.P.P. has opposed the prayer for bail on the ground that the petitioner has married with another lady who is petitioner no.3 in this case.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner no.1 (Md. Nausad Siddiqui @ Md. Nausad @ Chunnu).

So far petitioner nos. 2 and 3, above named, are concerned, in the event of arrest or surrender before the learned court below, they will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Bhagalpur in connection with Complaint Case No.524 of 2014, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
