2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 331(4) and 305 of the B.N.S.
3. The case of the prosecution in short is that unknown miscreants have committed theft in the house of the informant and they have taken away jewellery and valuables.
4. Learned counsel for the petitioner has submitted that the name of this petitioner has surfaced in the confessional statement of co-accused Mahesh. From perusal of the order of the learned trial court it is clear that learned trial court has recorded that from possession of this petitioner one locket was recovered. This petitioner has also confessed his guilt and in his confession he has stated that at the time of occurrence he was outside the house and was facilitating the other accused persons and having vigilant eye over the occurrence. Learned counsel for the petitioner has submitted that the locket which has been recovered from the possession of this petitioner belongs to him and it is not the stolen one. From perusal of the order od the learned trial court it is also clear that no TIP has been conducted regarding the stolen locket. It has also been submitted that the petitioner and the informant are agnates and they have been impleaded with ulterior motive. Learned counsel has lastly submitted that the petitioner is a man of clean antecedent and is in judicial custody since 31.08.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Arwal P.S. Case No. 285 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Arwal.
