The petitioner is apprehending his arrest in connection with Nathnagar P.S. Case No. 150 of 2019 for the offence registered under Sections 147, 148, 149, 341, 323, 325, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that though he is named in the first information report along with 14 other persons, the allegation against the petitioner is general and omnibus in nature and no specific role having been assigned to the present petitioner and, therefore, he may be extended the privilege of pre-arrest bail. It is further submitted that the entire allegation levelled against the petitioner is false and frivolous
Patna High Court CR. MISC. No.78674 of 2019(2) dt.03-12-2019 2/2 and the petitioner has no criminal antecedent. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Bhagalpur in connection with Nathnagar P.S. Case No. 150 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
