2. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 147, 148, 149, 323, 341, 342, 302 and 201 of the Indian Penal Code . 3 . As per the prosecution case , 15 F.I.R. named accused persons including this petitioner and 10 unknown accused persons attacked the Baarat Party and assaulted informant and his son. Later on, when the informant searched for his handicapped son, he could not find him and the police were informed. Thereafter, dead body of handicapped son of the informant was found in the river. It is alleged that all the accused persons killed the son of the informant.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.86688 of 2024(2) dt.14-02-2025 2/2 this petitioner has been made accused only on the basis of suspicion . The allegations levelled against this petitioner is general and omnibus. No specific overt act has been alleged against this petitioner. There is no material on record to show the involvement of this petitioner in the alleged occurrence . Petitioner is in custody since 23.08.2024 . Chargesheet has already been submitted.

5 . Learned counsel for the State opposed the bail petition .

6. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed.

7. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned learned Additional Chief Judicial Magistrate-VI, Danapur, Patna in connection with Naubatpur Police Station Case No. 373 of 2023 .
