2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. Petitioners along with other accused persons are said to have committed murder of the husband of the informant under a planned conspiracy.

4. Learned counsel for the petitioners submits that the petitioners is innocent and have been falsely implicated in this case. He submits that neither the dead body of the husband of the informant has been recovered from the house of the petitioner nor they have been caught from their home. He

Patna High Court CR. MISC. No.3300 of 2024(3) dt.16-04-2024 2/2 submits that there is no eye witness of the occurrence. He submits that there is specific allegation against the co-accused. He further submits that petitioners have no criminal antecedent as stated in para-3 of the bail application.

5. Learned APP for the State opposes the prayer for bail submits that there is sufficient material available in the case diary against the petitioners.

6. Considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Sakra (Bariarpur O.P.) P.S. Case No. 158 of 2023.
