The petitioner seeks regular bail in connection with Ishakchak PS case no. 146 of 2019 instituted for the offence punishable under Sections 504, 506, 385, 386/34 of Indian Penal Code and Section 27 of Arms Act. The allegation is regarding the petitioner and other co-accused persons being suspected of having come at the shop of the informant and having had cold drinks and cigarettes but on demand of money, they had refused to pay the same. It has been further alleged by the informant that on 16.09.2019 at about 6.30 hrs., while the informant was opening his shop, at about 10.30 am, co-accused person namely Ajay Yadav and two
Patna High Court CR. MISC. No.77306 of 2019(3) dt.16-12-2019 2/2 unknown boys have come to his shop and demanded ransom and upon refusal, they had resorted to firing, whereafter stampede had broken out.
The learned counsel for the petitioner has submitted that the petitioner has been booked in the present case merely on suspicion and no one has taken the name of the petitioner to be the person who had also engaged in demanding extortion money and resorting to firing. The petitioner is said to be having a clean antecedent and is languishing in custody since 21.09.2019.
Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak PS case no. 146 of 2019.
