2. The petitioner seeks bail in connection with Bypass P.S. Case No. 390 of 2023 dated 17.08.2023, instituted for the offence punishable under Sections 341, 323, 325, 307, 379, 504/34 of the Indian Penal Code.
3. The prosecution case in short, is that, there is a public toilet in the village which was used by the villagers jointly but the co-villagers namely, Bablu Kumar Singh (petitioner), Sunil Singh and Haricharan Singh restrained the informant for using the public toilet and started abusing and assaulting her. It is further alleged that co-accused Sunil Singh
Patna High Court CR. MISC. No.87481 of 2024(2) dt.10-01-2025 2/3 threw bricks on the face of the informant causing injury. Bablu Kumar Singh (petitioner) snatched gold pendant and assaulted the wife of informant. It is further alleged that Bablu Kumar Singh and Sunil Singh snatched Mangalsutra and Jitiya from the wife of informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that there is a specific allegation of assault with bricks causing lip and teeth injury to the informant against Sunil Kumar (co-accused). There is no specific allegation of assault against the petitioner. Allegation against the petitioner is of snatching gold Mangalsutra, Jititya and gold pendant from Radha Devi (wife of informant). Lastly, it has been submitted that the petitioner is in custody since 28.08.2024 having no criminal antecedents and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount
