2. The present appeal has been filed:

against the Judgment of conviction and order of sentence dated passed 13th day of February 2023 passed by Mr Avinash Kumar II, Addl. Sessions Judge 1st Darbhanga in Benipur, of Sessions Trial No.

342 of 2016 by which the appellant has been found guilty for the offence punishable under section 323 of the I.P.C and has been released with due admonition u/s 4 of the Probation of offenders Act after furnishing bond of Rs 5,000/- for keeping good conduct for 6 months.

3. After some argument, learned counsel for the appellant in the presence of learned APP prays for withdrawal of the petition.
