This is an application for grant of anticipatory bail in connection with Shahpur P.S. Case No. 223 of 2019 registered for the offence punishable under Sections 147, 341, 323, 504 and 307 of the Indian Penal Code.

The allegation is regarding the accused persons having tortured the victim lady on account of non-fulfillment of the demand for dowry and in the process, they are said to have assaulted the victim lady i.e. the informant of the present case. The learned counsel for the petitioner submits that the petitioner is the mother-in-law of the victim lady and at best, the husband of the victim lady can be said to be having some complicity in the matter with regard to his matrimonial dispute

Patna High Court CR. MISC. No.78396 of 2019(2) dt.03-12-2019 2/2 with the informant, however, the petitioner has got nothing to do with the alleged incident. It is further submitted that the petitioner is having a fair antecedent, apart from one case filed by the informant herself pertaining to the offence under Section 498A of the Indian Penal Code.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned JM 1st Danapur in connection with Shahpur P.S.Case No. 223 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
