JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-03-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 10716 of 2014, disclosing offences under Sections 498(A), 307, 406 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner is of subjecting his wife to cruelty with respect to demand of dowry. Submission of learned counsel for the petitioner is that it is alleged that the petitioner was married with the complainant on 16.03.2010 and on the very next day an F.I.R. had been lodged by the father of the petitioner for forcible marriage of the petitioner with the complainant and due to that the present false and concocted case has been lodged against the

Heard learned A.P.P. as well as learned counsel for the complainant, they have opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides, considering the facts and circumstances of the case as stated above, this application is disposed of and the provisional bail earlier granted to the petitioner vide order dated 28.01.2019 is confirmed subject to the condition that he will pay Rs.4,000/- (Rupees Four Thousand) per month as maintenance to the opposite party no.2/complainant for a period of one year and in the meantime, the opposite party no.2 shall file a case before the Family Court for maintenance and the petitioner shall also appear and cooperate in the disposal of the said maintenance case and the above amount of Rs.4,000/- paid by the petitioner to the opposite party no.2 shall subject to the outcome of the case.
