The petitioner seeks pre-arrest bail in connection with Digha P.S. Case No. 468 of 2018, registered under Sections 420, 406, 379, 411, 506 and 120B/34 of the Indian Penal Code. The accusation is that informant, Sabana Parveen, used to reside in the rented house of the petitioner, Raj Bansi Paswan. For some period she had gone to her house and when returned, then, found that her room is unlocked and her household-articles were also not there, then, the petitioner disclosed that due to plaster work of house, her house-hold-articles are kept safely. Instead of completing the plaster work, neither she was permitted to reside in rented house nor her house-holdarticles were returned to her by the petitioner. Later on, petitioner replied that there is no room in his house. At the instance of police her house-hold-articles recovered from the room of Anita, daughter-in-law of the petitioner.

Patna High Court CR. MISC. No.81502 of 2019(4) dt.01-07-2020 2/2 Submission is that in fact, the petitioner used to reside in the house of the petitioner on rent, but, she stopped to pay the rent and went to her house and when she returned, petitioner asked for rent, then, she lodged the present case on false allegation. More so, house-hold-articles of informant were found in her rented room. The petitioner is aged about 70 years and has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Digha P.S. Case No. 468 of 2018 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Subdivisional Judicial Magistrate, Patna, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
