JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 31-01-2020 The grievance of the petitioner in this case is that though the First Information Report was initially registered under various provisions of the I.P.C. including under Section 307 I.P.C. but because the brother of the accused namely Ram Naresh Sharma is posted in the same Police Station, under his influence allegedly Section 307 I.P.C. was converted in Section 308 I.P.C. by interpolation and overwriting in the margin portion of the First Information Report. It is his further grievance that even though the informant suffered injury on his head which has been said to

Learned counsel submits that in this regard he has represented vide Annexure '6' to the present application before the Inspector General of Police, Tirhut Region, Muzaffarpur as also to the Senior Superintendent of Police, Muzaffarpur, but they are not looking into the matter and because of their inaction the petitioner has been compelled to move this Court.

Learned counsel for the State is present and in the facts and circumstances of the case it is his submission that instead of keeping this Writ Application pending before this court, it may be disposed off with direction to the Senior Superintendent of Police, Muzaffarpur to look into the grievance of the petitioner, review the matter and take an appropriate decision thereon.

Considering the facts and circumstances of the case, this Writ Application is being disposed off with a direction to the Senior Superintendent of Police, Muzaffarpur (respondent no. 4) to look into the grievance of the

Patna High Court CR. WJC No.1782 of 2019(2) dt.31-01-2020 3/3 petitioner, review the matter based on the materials available on the record. He should take an appropriate decision and issue direction accordingly.

Let it be recorded that at this stage this court has not entered into the merit of the contentions and is leaving the entire things for the Senior Superintendent of Police, Muzaffarpur to take an appropriate action.

This Writ Application stands disposed off accordingly.
