1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Navinagar P.S. Case no.224 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per allegations in the F.I.R, four motorcycles were seized in a parked condition and on search 262.5 litres of liquor was recovered from them.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case only for the reason that he happens to be the registered owner of one of the motorcycles. No incriminating article has been recovered from his possession. The petitioner is in custody since 10.10.2024 and

Patna High Court CR. MISC. No.7260 of 2025(2) dt.21-02-2025 2/2 charge-sheet has been submitted in the case. He has no criminal antecedent. It is further submitted that co-accused Upendra Paswan has been enlarged on bail vide order dated 13.8.2021 passed in Cr. Misc. no. 16897 of 2021.

5. The application for bail is opposed by learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, no incriminating article having been recovered from the petitioner's possession, his having remained in custody since 10.10.2024, charge-sheet having been submitted in the case and especially the petitioner not having any antecedent under the Bihar Prohibition & Excise Act, 2016, the petitioner is directed to be enlarged on bail in connection with Navinagar P.S. Case no.224 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise-I, Aurangabad.
