Mr.Ashutosh Ranjan Pandey -Aag15 ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-07-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.
Petitioner is aggrieved by the order of suspension dated 24.07.2018 whereby the petitioner was put under suspension. The suspension order was passed one year back in contemplation of departmental proceeding.
Under the aforesaid circumstances, the Court does not find any justification to allow the suspension to continue any further after expiry of one year.
Accordingly, the writ application is allowed. The
Patna High Court CWJC No.19013 of 2018(3) dt.02-07-2019 2/2 order of suspension contained in Annexure-1 is hereby quashed. The respondents are granted liberty to conclude the departmental proceeding within a period of four months from the date of receipt/production of copy of this order, failing which the departmental proceeding shall also come to an end and the petitioner shall be entitled to all consequential benefits on reinstatement.
With the aforesaid, the present writ application stands disposed of.
