Petitioner apprehends arrest in connection with Complaint Case No. 94 of 2018 registered for the offence punishable under sections 420, 406 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. The present complaint has been lodged after delay of nine months. Petitioner has no concern with the sale and purchase of the land in question. Moreover, the dispute involved is civil in nature.
Patna High Court CR. MISC. No.61175 of 2018(6) dt.01-05-2019 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that earlier in this case no-coercive step was directed to be taken against this petitioner as the petitioner had agreed to refund the due amount, but up-till-now he has not refunded the agreed amount.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, this Court is not inclined to grant the privilege of bail to this petitioner. His prayer for grant of anticipatory bail is, therefore, rejected.
