This application has been filed for quashing the order dated 01.12.2023 passed by the learned ADJ-II, Aurangabad in Sessions Case No. 230 of 2023 arising out of Obra P.S. Case No. 85 of 2021.

The discharge application of the petitioner has been rejected by the impugned order and the learned trial Court has discussed the materials available on record and after finding a strong prima facie case, has rejected the discharge application and has directed for framing of charge.

Patna High Court CR. MISC. No.1720 of 2024(2) dt.16-07-2024 2/2 Since this is a case under Section 302 of the Indian Penal Code and charges can be framed even on the strong suspicion, this Court finds no ground to interfere in the impugned order.

Accordingly, this application is dismissed.
