That this is an application for issuance of an appropriate writ, order or direction, particularly in the nature of writ of mandamus for directing the respondents to hold an enquiry with regard to the details of land proposed by Abhishek Kumar (Respondent no.5) whose application no. is 15454835239483, which is adjacent to Bettiah-Nawalpur, National Highway, and for years, construction of the

Patna High Court CWJC No.24202 of 2019 dt.03-01-2023 2/2 highway within 50 to 55 feets is under way, there are already shops on the land proposed by respondent no. 5, and according to the agreement the land should have to be vacant one. And secondly the land proposed by the respondent no. 5 is the same land which has been proposed by one Sanjiv Kumar, being his application no. 15454658058729. The writ petitioner states and submits that after enquiry the selection of Abhishek Kumar for dealership of Bharat Petroleum Ltd. be cancelled, as the land furnished by Abkishek Kumar is not in accordance to the terms and agreements."

Learned counsel for the petitioner, under instruction, seeks permission to withdraw the present petition. Permission granted.
