2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 120B, 302 and 34 of the Indian Penal Code.
3. The case of the prosecution is that the son of the informant, namely, Pankaj Kumar and Aman Kumar went to Belaon Bazar for purchasing vegetables and after that, Pankaj Kumar handed over the vegetables to his younger brother Aman and assured him to return after some time. Later on, he did not return to his village. When the informant and other persons started searching the boy and during the search, the informant came to know that a dead body was lying at Maa Kali temple.
Patna High Court CR. MISC. No.86701 of 2025(2) dt.12-01-2026 2/3 When the informant went there along with his family members, he found the body of his son, namely, Pankaj Kumar. In the last part of the FIR, the informant has stated that he believes that seventeen persons are involved in the commission of the crime and petitioner is amongst them.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the nature of allegation is general and omnibus. It is only the suspicion of the informant on which, the petitioner has been named in this case. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. It has further been submitted that similarly situated other co-accused persons have already been granted bail by learned co-ordinate Bench of this Court vide order dated 28.07.2025 and 26.11.2025 passed in Cr. Misc. Nos. 33557 of 2025 and 63300 of 2025 respectively. The case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 30.08.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is

The above named petitioner is directed to be released on bail in connection with Bhagwanpur (Belaon) P.S. Case No. 156 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., VIIth, Kaimur at Bhabhua.
