1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Madhuban P.S. Case no.443 of 2022 registered under sections 307, 147, 149, 323, 336, 337, 341, 342, 353, 427 and 504 of the Indian Penal Code and section 3 of the Prevention of Damage to Public Property Act, 1984.

3. As per the prosecution case, the informant states that Lallan Sah who was creating nuisance in an intoxicated condition was caught. Thereafter it is stated that the accused persons including the petitioner herein interfered with the informant and others in carrying out their duties and forcibly got the aforesaid Lallan Sah released from police custody. 4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case because of enmity with the local chowkidar. He did not participate in any occurrence as alleged in the F.I.R. He is in custody since 8.10.2023 and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R. against this petitioner, the petitioner being in custody since 8.10.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Madhuban P.S. Case no.443 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran, Motihari.
