The petitioner seeks regular bail in connection with Sursand P.S. Case No. 377 of 2019 for the offence registered under Section 30(a) of the Bihar Prohibition & Excise Act. The allegation is regarding recovery of 16.8 litres of illicit liquor while the petitioner and one other co-accused person were arrested. As far as the petitioner is concerned, 8.400 litres of illicit Nepali Soufi wine is said to have been recovered. The learned counsel for the petitioner has submitted that the petitioner is innocent and he has been falsely implicated in the present case Lastly, it is submitted that the petitioner is languishing in custody since 15.10.2019.

Having regard to the facts and circumstances of the

No.77055 of 2019(2) dt.13-01-2020 2/2 case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise Act, Sitamarhi in connection with Sursand P.S. Case No. 377 of 2019.
