JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 This appeal has been filed against the order dated 22.10.2019 passed by the learned 1st Additional Sessions Judge, Nalanda at Biharsharif, in connection with Sarmera P. S. Case No. 152 of 2019, for the offences under Sections 384, 353, 504, 506, 34 of IPC and Section 3(i)(r)(s) of the SC/ST (Prevention of Atrocities) Act.

As per F.I.R. there is allegation against this appellant is that he on mobile threatened the informant, who happens to be the Block Development Officer and demanded Rs.09 lakhs and also abused him by taking his caste name. Apart from that he is accused in five other cases also, but in three cases, he has been acquitted.

Submission of the learned counsel for the appellant is

Patna High Court CR. APP (SJ) No.5278 of 2019(5) dt.06-01-2020 2/2 that the allegation itself shows that no such abuse in the public view and the allegation is false and concocted. Further submission is that in other three cases, he has already been acquitted.

Heard learned special P.P. also.

Having heard both sides, in view of the submissions, made above, this appeal is disposed of with a direction to the appellant to surrender and pray for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court and, if possible to be disposed of on the same day.
