====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-10-2018 Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Laukahi P.S. Case No. 123 of 2018 (G.R. No. 1035 of 2018) registered for the offence punishable under sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Section 25(1-b)a, 26, 35 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. He has no concern with liquor, vehicle and arms in question. Arms and cartridges were recovered from the possession of co-accused Lokesh Kumar

Patna High Court Cr.Misc. No.61202 of 2018(2) dt.08-10-2018 2/2 Mahto. Petitioner has no criminal antecedent and is in custody since 20.07.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Laukahi P.S. Case No. 123 of 2018 (G.R. No. 1035 of 2018).
