2. The petitioner seeks bail in connection with Saraiya P.S. Case No. 74 of 2003 registered for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code.

3. The petitioner is suspected to have participated in the killing of the deceased. The petitioner is in custody since 26.06.2023.

4. Learned counsel for the petitioner submits that there is no evidence direct or indirect against the petitioner. He further submits that similarly situated co-accused Vikas Kumar and Raja Kumar have been granted by this Court. The petitioner has clean antecedent.

5. Considering the period of custody and also the fact that the petitioner has clean antecedent, let the petitioner above named be released on bail after framing of charge if charges have not been framed, on furnishing bail bonds of Rs.10,000/-

Patna High Court CR. MISC. No.6141 of 2024(2) dt.17-02-2024 2/2 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 4th, Muzaffarpur in connection with Saraiya P.S. Case No. 74 of 2003.
