JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 Petitioner prays for bail in connection with Samastipur Muffasil P.S.Case No. 357 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Earlier prayer for bail of the petitioner was rejected vide order dated 25.6.2018 in Cr.Misc.No. 23738 of 2018 and there is allegation as per FIR is that on hearing sound of firing the informant came running and found her husband dead and she saw petitioner and other accused persons, including Ujal Mishra.

Submission of learned counsel for the petitioner is that the said Ujal Mishra has been granted bail vide order dated 24.7.2018 in Cr.Misc.No. 27382 of 2018 and prayer for bail of

Patna High Court Cr.Misc. No.60342 of 2018(3) dt.05-11-2018 2/2 the petitioner was rejected by the then co-ordinate Bench of this Court on the ground that prayer for bail of Ujal Mishra was rejected by this Court and moreover petitioner is in custody for more than one year.

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Samastipur, in connection with Samastipur Muffasil P.S.Case No. 357 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
