2. The petitioner apprehends his arrest in connection with Sahebpur Kamal P.S. Case No.187 of 2025 registered for the offences punishable under Sections 120(2), 115(2), 352, 351(1), 351(2), 109(1) and 3(5) of the BNS.

3. In the evening of the fateful day, all the FIR named accused persons, including the petitioner caught hold the informant and started abusing. When the protest was made, on the exhortation made by co-accused Shambhu Kumar, one Alok Kumar Gupta shot him by pistol which hit in his chest due to which he fell down.

4. Learned Advocate for the petitioner referring to the

Patna High Court CR. MISC. No.83099 of 2025(2) dt.17-12-2025 2/3 FIR contended that even if the allegation levelled in the FIR is taken to be true, admittedly, the petitioner has not actively participated in the crime, rather he is said to be one of the members present at the place of occurrence. The specific accusation has been levelled against Alok Kumar Gupta, who shot fire upon the informant. The petitioner has nothing to do with the occurrence. He bears fair antecedent and undertakes that he will fully cooperate in the proceeding of the Court.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioner along with other have not only assaulted the informant, one of the accused persons shot fire due to which he sustained a bullet injury.

6. Having considered the submissions set forth by the learned Advocate for the respective parties and taking note of the nature of limited accusation against the petitioner, coupled with his fair antecedent, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with

Patna High Court CR. MISC. No.83099 of 2025(2) dt.17-12-2025 3/3 Sahebpur Kamal P.S. Case No.187 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioner.
