1. Heard learned counsel for the petitioner, learned APP for the State along with learned counsel appearing on behalf of the O.P. No.2
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 323, 504, 506, 498A and 307 of the IPC and Section 3⁄4 of the Dowry Prohibition Act.
3. The petitioner and the O.P. No.2 in compliance of the order dated 18.04.2024 are present in the Court.
4. The O.P. No.2 at the outset submits that she is not opposing the anticipatory bail application of the petitioner. It is also submitted that they are living a peaceful conjugal life along
Patna High Court CR. MISC. No.2149 of 2024(5) dt.22-04-2024 2/2 with her daughter, who is aged about 06 years. The petitioner who is present in the Court also submits that he will ensure the well being of the O.P. No.2 and his daughter and will keep them with honour and dignity.
5. Considering the submissions made by the O.P. No.2 in-person, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Complaint Case No.305C of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
