The petitioner apprehends his arrest in connection with Kiul Rail P.S. Case No. 01 of 2018 registered for the offence punishable under Section 379 of the Indian Penal Code. As per F.I.R., it is alleged that on 01.01.2018, lthe informant along with his niece was travelling in the train bearing No.13287 in Coach No.S-6 and he slept on berth no.57 and his niece slept on berth no.60. It is further alleged that on 02.01.2018 at 5.30 A.M., when his niece woke up at Lakhisarai, she found her ladies bag missing. It is also alleged that cash of Rs.5,000/-, mobile of M.I. Company containing SIM No.8825372711 and 8292725140, golden chain, ear tops and

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. During investigation, the petitioner has been made accused in the present case. He further submits that the petitioner is on police bail, which is mentioned in paragraph 59 of the case diary. He further submits that the charge sheet has been submitted against the petitioner. In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Kiul, Lakhisarai in connection with Kiul Rail P.S.
