2. The petitioner has preferred this application for grant of regular bail in connection with Ballia P.S. Case No. 154/2025 dated 08.05.2025 registered for the offences punishable u/s 61(2) of the BNS and sections 3, 4, 5, 6, 7 and 8 of the Immoral Traffic of Prevention Act.
3. As per the prosecution case, on secret information, police conducted a raid and apprehended some male and females members from a house situated near Dandari Dhala at Mathurapur and some of the co-accused persons succeeded to flee away who were indulged in immoral trafficking act. It is further alleged that raiding a team also seized some
Patna High Court CR. MISC. No.82360 of 2025(2) dt.08-12-2025 2/3 objectionable articles from the place of occurrence. The apprehended persons also disclosed the name of the persons who succeeded to flee away as Pinki Devi, Soni Devi and Mano Devi (petitioner).
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner was disclosed by the apprehended co-accused persons. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has not indulged in any immoral traffic act. The petitioner is a lady. The other co-accused person has already been granted regular bail by this court vide order dated 20.08.2025 passed in Cr. Misc. No. 56869/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 15.09.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. Earlier the anticipatory bail of the petitioner was rejected by the coordinate bench of this court vide order dated 02.09.2025 passed in Cr. Misc. No. 57191/2025.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-
Patna High Court CR. MISC. No.82360 of 2025(2) dt.08-12-2025 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Ballia P.S. Case No. 154/2025, with the condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.
7. The application stands allowed.
