2. The present Writ Petition has been filed for the following reliefs:- ".....for a direction to the respondent No. 4 to 7 to settle the land for home according to the circular of Bihar Government. The petitioner is belong to SC/ST and landless. He is residing on government land having made a home from 48 year bearing Khata No. 110 plot No.

1033 area 4 decimal, Thana No. 707 Anchal Rafiganj District Aurangabad, Bihar and after then she has taken a electric line from electric department government of Bihar in his mother in law

3. Without going into the merits or demerits of the case, the present writ petition is disposed of at the stage of admission with the consent of both the Counsels.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is a landless poor person belong to Scheduled Caste Category. Learned counsel submits that the petitioner has given a representation dated 26.04.2025 for settlement of the land which is in possession of the petitioner for more than 40 years to the District Magistrate, Aurangabad, Bihar i.e. Respondent No. 4 herein for allotment of the Government land but till date the authorities have not passed any orders on the same. Learned counsel submits that the present writ petition may be disposed of directing the Respondent No. 4 herein to consider the said representation by fixing a time frame.

Per contra, the learned counsel appearing on behalf of the Respondent-State submits that the petitioner has to give a suitable representation ventilating her grievance to the Circle Officer, Anchal Rafiganj, District Aurangabad, Bihar i.e. Respondent No. 7 herein and, in case, any such application is made, the same shall be considered under the relevant

Patna High Court CWJC No.20471 of 2025(2) dt.24-12-2025 3/3 provisions of the Bihar Privileged Persons Homestead Tenancy Act, 1947.

Having regard to the same, the present writ petition is disposed of granting liberty to the petitioner to give a suitable representation to the Respondent No. 7 herein within a period of four weeks from today. On such representation being given, the authority i.e. Respondent No. 7 herein shall consider the same strictly in accordance with law and pass necessary orders duly taking into account the provisions of the Bihar Privileged Persons Homestead Tenancy Act, 1947. The authority shall endeavour to pass necessary orders as expeditiously as possible preferably within a period of 12 weeks from the date of the receipt of the copy of the representation from the petitioner. Any orders passed shall be communicated to the party.

7. With the above directions, the present writ petition stands disposed of.
