The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.
The prosecution case, in brief, is that while the informant and his father were cultivating their field, all the accused persons started the informant and his family members. In that course, Rs. 5,000/- was also taken away by the accused persons. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. Both parties are agnates. There is case and counter case between the parties. A free-fight is alleged to have taken
Patna High Court Cr.Misc. No.60598 of 2018(3) dt.27-11-2018 2/2 place. The injury on the side of the accused has not been explained by the prosecution.
On behalf of the State and the counsel for the informant, it is submitted that the petitioner is named in the F.I.R. Injury Nos. 3, 4 & 5 are said to be grievous in nature.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner in connection with Rauta P.S. Case No. 66 of 2018 is rejected. If the petitioner surrenders in the court below and seek regular bail, the same shall be considered on its own merit without being prejudiced by this order.
