2. The petitioner apprehends his arrest in connection with Saraiya P.S. Case No.755 of 2023 dated 06.11.2023for the offences punishable under Sections 376, 323 and 506 of the Indian Penal Code and Section 4, 6 and 8 of the POCSO Act pending in the Court of learned Special Judge, POCSO Act, Muzaffarpur.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application to surrender before the learned Court below and seek regular bail.

4. Permission is accorded.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within four weeks from today and seeks regular bail, the learned Court below would consider the same, preferably on the same day, without being prejudiced by this withdrawal order.
