JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-06-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in connection with Dehri (Dalmia Nagar) P.S. Case no. 143 of 2019, registered under Sections 302 and 120B)/34 of the Indian Penal Code.
The accusation is that the marriage of Sangita Devi, daughter of informant, was performed before twenty years with Motilal Sah, son of the petitioners, in villageKhuriya and his daughter was sent in Bidai at her matrimonial house. Thereafter, his daughter came to know that her husband has illicit relation with his Bhabhi Usha Devi due to that

On several occasions, she was removed from her matrimonial house for which Panchayati was aslo arranged, but, there was no improvement in the behaviour of her husband and other in-laws. It is alleged that her husband Motilal Sah wanted to perform his remarriage, but, on protest, he could not succeed to perform his re-marriage. On 05.03.2019, informant came to know that his daughter has been killed at Dalmia Nagar then informant went there and saw the dead body of his daughter.
Learned counsel for the petitioners submits that, admittedly, the petitioners are father-in-law and mother-in-law of the deceased, daughter of informant, but both used to reside at their native village- Khuriya, while the deceased along with her husband used to reside at Dalmiya Nagar at his business place, but, with ulterior motive, the petitioners have falsely been implicated in this case.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of
Patna High Court CR. MISC. No.82228 of 2019(3) dt.26-06-2020 3/3 the like amount each to the satisfaction of the learned S.D.J.M. Dehri (Rohtas) in connection with Dehri (Dalmia Nagar) P.S. Case No. 143 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
