The petitioner seeks bail in Garkha P.S. Case No.107 of 2019 registered under Sections 395 and 397 of the Indian Penal Code.

The informant lodged the case against unknown for looting a box containing Rs.48 lacs in front of Allahabad Bank, Rampur.

The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner figured in the case in the confessional statement of Pappu Manjhi. Pappu Manjhi has already been enlarged on bail. Similarly situated co-accused namely, Jyoti Kumar, Kanhaiya Kumar @ Kanhaiya Sah, Hanumant Kumar and Pappu Manjhi

Patna High Court CR. MISC. No.79506 of 2019(3) dt.04-06-2020 2/2 have been granted bail by different Benches of this Court. Petitioner is in jail since more than six months only because the petitioner has got criminal antecedent. There is absolutely no evidence against the petitioner.

Mr. Sanjay Kumar Tiwary, learned A.P.P. did not dispute this fact.

Considering the fact that name of the petitioner figured in the case in the confessional statement of Pappu Manjhi but nothing has been recovered from the possession of the petitioner and Pappu Manjhi has already been enlarged on bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. XIV, Saran at Chapra in connection with Garkha P.S. Case No.107 of 2019.
