2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 327, 379, 504 and 506 of the Indian Penal Code.
3. As per prosecution case, this petitioner is alleged to have assaulted on the head of informant with sword. Doctor has found the injuries sustained by the informant to be grievous in nature.
4. It is submitted by learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in this case. As a matter of fact, on the alleged date of occurrence, due to admitted land dispute between the parties, a free fight took place in which both sides sustained injuries. There is case and counter-case between the parties. Petitioner is in custody since

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances, case and counter-case between the parties and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Purnea in connection with Dagarua P.S.
