The petitioner seeks regular bail in connection with Chhauradano (Mahuawa) P.S.Case No.331 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of more than 150 ltrs. of liquor from the motorcycle. Two persons were arrested and it is said that the petitioner succeeded in fleeing away..

Submission of the learned counsel for the petitioner is that his name was disclosed by two apprehended accused persons, nothing has been recovered from his possession and the motorcycle does not belong to the petitioner. He is in

Patna High Court CR. MISC. No.77084 of 2019(2) dt.13-01-2020 2/2 custody for more than three months. Charge sheet has already been submitted and he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, East Champaran at Motihari in connection with Chhauradano (Mahuawa) P.S.Case No.331 of 2019.

With the aforesaid observation, this application is allowed.
