Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 05-03-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner is apprehending his arrest in connection with Ariyari P.S. Case No. 123/2020, dated 22.11.2020 for the offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is alleged to have got job of Niyojit Panchayat teacher, Primary School Jodhanbigha on the basis of forged and fabricated certificates. The education certificate, training certificate and BETET certificate of the petitioner have been found to be fake, during EPF DATA ONLINE.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated

Patna High Court CR. MISC. No.2810 of 2024(4) dt.05-03-2024 2/2 in this case. The petitioner has no criminal antecedent stated in para 3 of the bail petition. Learned counsel further submitted that the petitioner was appointed in the year 2014 and F.I.R. has been lodged in the year 2020 without any inquiry. He has dismissed from the service. There is no any cogent material found against the petitioner.

5. Learned APP for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the allegation is general and omnibus against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Sheikhpura in connection with Ariyari P.S. Case No. 123/2020, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
