Mr. Damodar Prasad Tiwary ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 16-04-2024 Heard learned counsel for the petitioners, Mr. Shailendra Kumar Jha and learned A.P.P. for the State.

2. The petitioners are apprehending their arrest in connection with Biraul P.S. Case No. 444 of 2023 corresponding to G.R. No. 827 of 2023 for the offence under sections 341, 323, 342, 379, 504, 506, 34 of the I.P.C. lodged on 06.09.2023 by the informant, Saroj Kumar Mahto.

3. As per the prosecution story, the informant alleged that these petitioners as also other accused persons intercepted and brutally assaulted. The allegation of choking the neck as also snatching of amount/chain is/are also there.

4. Learned counsel for the petitioners submits that it is a counterblast to the earlier case of Amarnath Yadav wherein a complaint was filed against the brother of the present informant alleging that due to the homeopathic medicines given by him, his liver and kidney got damaged. As a counterblast this case.

5. Learned A.P.P. for the State has pointed out that learned Sessions Judge recorded the fact that the injuries were found on the person of the informant. He further submits that they have criminal antecedent.

6. Taking into account the aforesaid facts as also the allegation of assault has been corroborated by the injuries suffered by the informant, it would be appropriate that the petitioner seek bail.

7. Cr. Misc. No.6928 of 2024 stands rejected. (Rajiv Roy, J) Guddu/- U T
