2. The petitioner apprehends his arrest in connection with Manihari P.S. Case No.179 of 2025 registered for the offences punishable under Sections 115(2), 126(2), 189(2), 191(2), 333, 118(2), 109 and 124(1) of the BNS.

Allegedly, on the fateful day, while the wife of the informant was cooking food, in the meanwhile, the petitioner along with others barged into the courtyard of the informant and started digging land. When the protest was made, they demanded six decimal of land. It is also alleged that the accused persons along with the petitioner sprinkled the petrol over the hutment of the informant and co-accused Dashrath Prasad Singh ignite the same through the matchbox which caused fire in the

4. Learned Advocate for the petitioner, referring to the FIR, contended that the parties are agnates and they were bickering over a land dispute. On account of some unfortunate incident of fire, which broke in the kitchen of the informant and when they tried to extinguish the same, they sustained some injuries and taking shelter of such incidents, they have instituted the present case in order to settle the score. Moreover, the injuries which are allegedly sustained to the informant and his family members, all of them are simple in nature. To support the aforesaid contention, the injury reports of the injured have been placed on record as Annexure-2 series to the bail application.

It is further contended that the falsity of the case is also writ large for the simple reason that as per the allegation, the petitioner had sprinkled the petrol all over hutment, but the fire was broken out only in the kitchen, which makes the entire case doubtful. There is a counter version of the present case being Manihari P.S. Case No.173 of 2023, which is on earlier point of time instituted against the informant and others. Moreover, the petitioner undertakes that he will fully cooperate in the proceedings of the Court.

5. On the other hand, learned Advocate for the State submitted that the allegation is very serious in nature causing arson to the house of the informant which led to the burn injuries to the informant and others.

6. Having considered the submissions set forth by the learned Advocate for the respective parties and the institution of Manihari P.S. Case No.173 of 2023 prior to the present case, besides the simple nature of injuries sustained to the informant and others as also the undertaking given by the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Manihari P.S. Case No.179 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioner.
