1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 379, 504 and 506 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the instant anticipatory bail application has been filed in terms of the liberty granted to the petitioner by an order dated 02.09.2025 in Cr. Misc. No.55556 of 2025. It is next submitted that petitioner is the person with clean antecedent and the informant alleges that on 20.05.2023 at about 9.00 A.M., the accused persons including the petitioner came and assaulted his labourers after entering his house and when informant objected,
Patna High Court CR. MISC. No.82760 of 2025(2) dt.17-02-2026 2/3 the accused persons also assaulted him by means of lathi, danda and bricks on account of which, he was injured. It is further alleged that accused persons also snatched gold chain and cash of Rs.47,600/- from him.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from the side of the petitioner, Surajgarha P. S. Case No. 181 of 2023 has been instituted by Sagar Yadav. It is also submitted that allegation of assault is general and omnibus in nature i.e. no overt act is alleged against the petitioner and most of the injuries suffered by the injured is opined to be simple in nature. It is also submitted that Chhabila Yadav along with six others had approached this Court seeking anticipatory bail by filing Cr. Misc. No.35453 of 2024 and the same came to be allowed by an order dated 19.08.2024 passed by a learned Coordinate Bench.
5. Learned A.P.P. opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail
Patna High Court CR. MISC. No.82760 of 2025(2) dt.17-02-2026 3/3 on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Surajgarha P. S. Case No.180 of 2023, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
7. The application stands allowed.
