2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 342, 323 , 324, 307, 379, 448 , 504, 506 and 34 of the Indian Penal Code.
3. As per FIR, on the alleged date and time of occurrence , petitioner No. 1 is alleged to have assaulted the informant by means of iron rod on his head and when one Randhi kumar and one Indra devi came to rescue
Patna High Court CR. MISC. No.2741 of 2024(3) dt.07-03-2024 2/3 they were assaulted by petitioner No. 2 by means of axe due to which they all sustained injury . It is further alleged that they also took cash of Rs. 64,000/- cash and ornament of Rs. 2,13,000/-.
4. It is submitted on behalf of the petitioners that there is general and omnibus allegation of assault against these petitioners. Injury sustained by the injured is found to be simple in nature . Rest of the allegation is super addition to make the case grave . Petitioners claim clean antecedent.
5. Learned counsel for the State oppose the bail petition.
6 Considering the nature of injury and clean antecedent of the petitioners, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Court of 4th Judicial Magistrate , Muzaffarpur, East in connection with
