The present MJC application has been filed for restoration of CWJC No. 16895 of 2013 which stood dismissed for non-prosecution vide order dated 20.3.2018. It appears from the records that earlier vide order dated 4.5.2017 the aforementioned writ application was dismissed as infructuous as it was submitted by learned AC to SC 25 that the grievances of the petitioner were redressed. However, none had appeared on behalf of the petitioner. However, CWJC No. 16895 of 2013 was subsequently restored to its original file vide order dated 3.1.2018 passed in MJC No. 2873 of 2017. Second time, the writ application was dismissed

Patna High Court MJC No.3805 of 2018(2) dt.03-10-2018 2/2 for non-prosecution vide order dated 20.3.2018. It is submitted by learned counsel for the petitioner that since he was ill, hence he could not appear. In the circumstances, on the grounds mentioned in the restoration application, CWJC No. 16895 of 2013 is restored to its original file.
