Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 10.5.2017 passed in Cr. Misc. No.22486 of 2017.

Allegation is of kidnapping of the daughter of the informant.

Submission of the learned counsel for the petitioner is that the petitioner is in custody for for 3 1⁄2 years and five witnesses have been examined out of 09 witnesses as such there is no likelihood of conclusion of the trial in near future. .

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court CR. MISC. No.5477 of 2019(3) dt.04-04-2019 2/2 bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conduct it on regular basis so that it may be concluded as expeditiously as possible. At the same time, the Sr.S.P., Gaya is directed to ensure presence of the witnesses.

With the aforesaid direction, this application is dismissed.
