Petitioner seeks bail in a case registered for the offences punishable under Sections 30,30(a) of the Bihar Prohibition and Excise Act, 2016.

Liquor was recovered from behind the outer house of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 20.10.2019. Investigation of the case is already complete. Submission is that the place of recovery is accessible by anyone. There is no material to substantiate that the petitioner is not going to cooperate with the trial or is going to tamper with the evidence.

Considering the submission aforesaid and the fact that

No.76909 of 2019(2) dt.13-01-2020 2/2 there is no material against the petitioner is going to abscond the process of law or is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Derni Police Station Case No.190 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
